1. Acceptance of Terms

By downloading, installing, or using Sweet Not Sugar (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Sweet Not Sugar ("we," "our," or "us").

2. Description of Service

Sweet Not Sugar is a mobile application that uses AI-powered food analysis to help users track their sugar intake. The App provides nutritional estimates based on food photos and manual entries, tracks daily sugar goals, and offers personalized health insights.

The App is intended for general wellness purposes only and is not a medical device or medical service.

3. Not Medical Advice

IMPORTANT: Sweet Not Sugar is not a medical service. All nutritional information, sugar estimates, health scores, and recommendations provided by the App are for informational and wellness purposes only.

The App does not:

  • Provide medical diagnoses or treatment
  • Replace advice from a qualified healthcare professional
  • Guarantee the accuracy of AI-generated nutritional analysis

If you have diabetes, a metabolic condition, or any health concern, consult a licensed physician or registered dietitian before making dietary changes based on this App.

4. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

5. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

You may use the App with limited functionality without creating an account. Guest data is stored locally on your device and may be lost if the app is uninstalled.

6. Subscriptions & Payments

6.1 Free & Premium Tiers The App offers a free tier and a Premium subscription. Premium features are accessible only with an active paid subscription.

6.2 Billing Subscriptions are billed through the Apple App Store or Google Play Store. Pricing is displayed at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

6.3 Free Trials If a free trial is offered, you will not be charged during the trial period. After the trial ends, your subscription begins automatically unless cancelled beforehand.

6.4 Cancellations & Refunds You may cancel your subscription at any time through your App Store account settings. Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not issue refunds directly.

6.5 Price Changes We reserve the right to change subscription prices. We will provide reasonable notice of any price change before it takes effect.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Upload content that is offensive, harmful, or violates any third-party rights
  • Use automated tools to scrape, crawl, or extract data from the App
  • Interfere with or disrupt the App or its servers
  • Misrepresent your identity or impersonate any person

8. User Content

You retain ownership of content you submit (such as food photos). By submitting content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you.

We do not use your food photos or personal health data to train AI models or for any purpose other than providing the Service.

9. AI Analysis Accuracy

The nutritional information provided by the App is generated by AI and is an estimate only. Accuracy may vary depending on image quality, food presentation, portion size, and other factors.

We make no warranties about the accuracy, completeness, or reliability of any AI-generated nutritional data. You acknowledge that results may differ from actual nutritional values.

10. Intellectual Property

The App, including its design, code, branding, and content (excluding user content), is owned by Sweet Not Sugar and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWEET NOT SUGAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR HEALTH-RELATED DAMAGES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Consumer Rights Act 2015 (UK) or equivalent consumer protection legislation.

14. Indemnification

You agree to indemnify and hold harmless Sweet Not Sugar and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We reserve the right to suspend or terminate your account and access to the App at our discretion, without notice, if you violate these Terms or engage in conduct we determine to be harmful.

You may delete your account at any time by contacting us. Upon termination, your right to use the App ceases immediately.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing in-app notice. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. However, as the App is primarily marketed to users in the United States, we also comply with applicable US federal and state consumer protection laws.

If you are a consumer in the UK or European Economic Area, you benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your statutory rights.

Any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales, provided that users in other jurisdictions may also bring claims in their local courts where required by applicable law.
